YOU MUST AGREE TO ALL OF THE TERMS AND CONDITIONS CONTAINED IN THIS AGREEMENT
TO BECOME A USER OF ANY JAF SITE, INCLUDING THE CLIENT SITES / YOUR AGREEMENT TO THESE TERMS PERMITS YOU TO
ACCESS AND/OR PURCHASE (I) CERTAIN MATERIALS CREATED, COMPILED AND/OR PRODUCED
BY JAF ("JAF MATERIALS") OR (II) SERVICES PROVIDED THROUGH ANY OTHER
JAF SITE. BY COMPLETING THE
ENROLLMENT PROCESS AND/OR USE OF ANY JAF SITE OR JAF MATERIALS OR SERVICES, YOU
AGREE TO THE TERMS OF THIS AGREEMENT, JUST AS IF YOU HAD SIGNED THIS AGREEMENT.
IF YOU DO NOT WISH TO BE BOUND BY THIS AGREEMENT, PLEASE DO NOT COMPLETE THE
ENROLLMENT PROCESS AND/OR DISCONTINUE USE OF THE SITE.
- Changed Terms.
JAF may change or discontinue any aspect of its web site at any time,
including, its content or features. JAF reserves the right to change the
terms and conditions applicable to use of the JAF Materials or any JAF
site.
Such changes shall be effective immediately upon notice, which shall be
placed on the web site. Use of the JAF Materials or any JAF site after
notice shall be deemed to be acceptance by User of such changes.
- Term.
JAF may terminate User's access at any time for any reason. The provisions
regarding Disclaimer of Warranty, Accuracy of Information, Indemnification,
and Third Party Rights shall survive.
- Copyright and License of Product.
The JAF Materials posted on any JAF site are the property of JAF and
are protected by U.S. and international copyright law and conventions. User
acknowledges that access to the JAF Materials is limited to the License
terms set forth herein and any expansion must be in writing. The granting of
the License to access and use the JAF Materials is conditioned on User's
agreement not to disclose, copy, disseminate, redistribute, or publish JAF Materials, or any portion of or excerpts of
JAF Materials to any other party
User shall have the right to use the JAF Materials solely for its own
internal information purposes. As such, JAF grants User a limited, personal,
non-exclusive and non-transferable license to use and display the materials
only on your personal computer only for purposes associated with User's
interaction with any JAF site. Reproduction,
modifying, editing, republishing, licensing, public display or other use of
the JAF Materials in any form or by any means except as expressly provided
by these Terms of Use is forbidden without JAF's written permission.
User agrees (i) to maintain all copyright, trademark and other notices
contained on JAF Materials; and (ii) that it shall not use JAF's name or any
excerpts from the JAF Materials in the promotion of its products or
services.
- Disclaimer of Warranties.
Although JAF takes reasonable steps to screen for infection by viruses,
worms, Trojan horses or other code manifesting contaminating or destructive
properties before making the JAF Materials or other services available, JAF
cannot guarantee that any products or services will be free of infection.
The JAF sites may be linked to other sites on the World Wide Web that are
not under the control of or maintained by JAF. Such links do not constitute
an endorsement by JAF of any such sites. You acknowledge that JAF is
providing these links to you only as a convenience, and you agree that JAF
is not responsible for the content or links displayed on such sites to which
you may be linked.
ALL JAF MATERIALS, SERVICES AND SITES ARE PROVIDED TO YOU ON AN "AS
IS" AND "WHERE-IS" BASIS, WITHOUT ANY WARRANTY. JAF, FOR
ITSELF AND ANY THIRD PARTY PROVIDING MATERIALS, SERVICES, OR CONTENT TO THE
JAF MATERIALS OR SITES, MAKE NO REPRESENTATIONS OR WARRANTIES IN CONNECTION
WITH THE JAF MATERIALS OR SITES INCLUDING BUT NOT LIMITED TO THE QUALITY,
SUITABILITY, TRUTH, ACCURACY OR COMPLETENESS OF ANY MATERIAL, INFORMATION,
PRODUCT, OR SERVICES. ALL CONDITIONS, REPRESENTATIONS AND WARRANTIES,
WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING ANY IMPLIED
WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR
NON-INFRINGEMENT OF THIRD PARTY RIGHTS, ARE HEREBY DISCLAIMED. JAF WILL NOT
BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGES OF ANY KIND, INCLUDING
BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE
DAMAGES, ARISING FROM OR CONNECTED WITH THE JAF MATERIALS OR ANY JAF SITE,
INCLUDING BUT NOT LIMITED TO, YOUR USE OF ANY JAF SITE OR YOUR INABILITY TO
USE ANY JAF SITE, EVEN IF JAF HAS PREVIOUSLY BEEN ADVISED OF THE POSSIBILITY
OF SUCH DAMAGES.
- Accuracy of Information.
The information contained in the JAF Materials or on any JAF site may
include information gathered by JAF from third party sources believed to be
reliable. In addition, information exchanged in chat rooms or discussion
groups solely represents the views and information of the parties who post
the information and are not the views or responsibility of JAF. JAF
disclaims all warranties as to the accuracy, completeness or adequacy of all
such information available on its sites or as part of the JAF Materials. The
reader assumes sole responsibility for the selection of the JAF Materials or
any services offered through an JAF site to achieve its intended results.
- Limitation of Liability.
In no event will JAF be liable for:
- damages of any kind, including without limitation, direct, incidental
or consequential damages (including, but not limited to, damages for
lost profits, business interruption and loss of programs or information)
arising out of the use of or inability to use JAF's sites or the JAF
Materials, or any information or services provided on the sites, or in
the JAF Materials;
- any claim attributable to errors, omissions or other inaccuracies in
the JAF Materials, or interpretations thereof, and/or services provided
through the JAF sites; or
- any defamatory, offensive or illegal conduct of any user.
- Indemnification.
User agrees to indemnify, defend and hold harmless JAF, its affiliates,
licensors, and their respective officers, directors, employees and agents
from and against all losses, expenses, damages and costs, including
reasonable attorneys' fees, arising out of the use of the JAF Materials by
User or User's account.
- Third Party Rights.
The provisions regarding Disclaimer of Warranty, Limitation of Liability and
Indemnification are for the benefit of JAF, and its licensors, employees and
agents. Each shall have the right to assert and enforce those provisions
against a User.
- Governing Law.
This Agreement and the resolution of any dispute arising hereunder shall all
be governed and construed in accordance with the laws of the state of
New Jersey, without regard to its conflicts of law principles. User consents
to the jurisdiction of the courts of the State of New Jersey. County of
Gloucester.
